Terms of Service

Welcome to Next Move Spain. By accessing or using our website and platform at nextmovespain.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Definitions

• "Service" refers to the Next Move Spain platform, including all features, tools, content, and AI-powered assistance.
• "User" refers to any individual who accesses or uses the Service.
• "Premium Subscription" refers to the paid plans (Monthly or Annual) that unlock additional features.
• "Content" refers to all text, guides, plans, checklists, and AI-generated responses provided through the Service.

2. Eligibility

You must be at least 16 years old to use the Service. By registering, you represent and warrant that you meet this age requirement and that the information you provide is accurate and complete.

3. Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised use of your account.

4. Subscriptions and Billing

4.1 Plans

We offer a Free plan and Premium Subscription plans (Monthly at €19.99/month and Annual at €149.99/year). Prices are in EUR and include applicable VAT where required.

4.2 Payment

Premium Subscriptions are billed through Stripe, our payment processor. By subscribing, you authorise Stripe to charge your designated payment method for the subscription fees on a recurring basis (monthly or annually) until you cancel.

4.3 Renewal

Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You can cancel at any time from your account or the Stripe billing portal. Cancellation takes effect at the end of the current billing period — you retain access until then.

4.4 Refunds

Subscription fees are non-refundable, except where required by law. If you believe you have been charged in error, contact us at support@nextmovespain.com within 14 days of the charge.

4.5 Price Changes

We may change subscription fees with at least 30 days' notice. Changes take effect at the next renewal after the notice period. You may cancel before the new price takes effect.

5. AI-Powered Features

The Service includes AI-generated content such as relocation plans, visa recommendations, document checklists, and chat responses. This content is generated by artificial intelligence and is for informational purposes only.

AI-generated content may contain inaccuracies or errors. You must independently verify all information, especially regarding legal, tax, immigration, and financial matters. AI responses do not constitute legal, financial, or immigration advice. Always consult a qualified professional (e.g. immigration lawyer, tax advisor) before making decisions based on AI-generated content.

We are not liable for any decisions or actions you take based on AI-generated content.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable laws.
• Attempt to gain unauthorised access to the Service, its systems, or other users' data.
• Interfere with or disrupt the Service, including introducing malware or overloading servers.
• Submit content that is unlawful, defamatory, infringing, or otherwise harmful.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use AI features to generate content that is harmful, misleading, or illegal.
• Resell or redistribute access to the Service without our written permission.

7. Your Content

You retain ownership of the content you submit to the Service (e.g. profile data, uploaded documents, AI conversations). You grant us a limited licence to use your content solely to provide and improve the Service for you.

You are responsible for ensuring you have the right to upload any documents and that they do not infringe third-party rights.

8. Intellectual Property

The Service, including its design, branding, guides, and software, is owned by Next Move Spain and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. AI-generated content may be inaccurate and should not be relied upon as legal, financial, or immigration advice.

10. Limitation of Liability

To the maximum extent permitted by law, Next Move Spain shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service or AI-generated content.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Next Move Spain from any claims, damages, or expenses arising from your breach of these Terms or your misuse of the Service.

12. Termination

You may close your account at any time. We may suspend or terminate your access if you breach these Terms or engage in harmful activity. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination (e.g. disclaimers, liability limits) remain in effect.

13. Governing Law

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection rights you may have.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
